Laban Konsyumer Inc. appealed Monday the decision of the Energy Regulatory Commission to increase the in feed-in-tariff allowance granted to renewable energy producers.

The consumer group said “the assailed decision is null and void and without legal effect… ”

LKI president Victorio Dimagiba said the decision must be reconsidered because it granted a higher FIT-All rate of P0.2563 per kilowatt-hour despite the lower FIT-All rate of P0.2291/kWh requested by National Transmission Corp. It said the ERC ruling was an “act of grave abuse of discretion tantamount to lack or excess of jurisdiction on the part of this Honorable Commission.”

“It is evident that Transco failed to comply with the notice… requirements of the Commission when it recalculated and asked… for a higher FIT-All rate of P0.2481/kWh. Such re-computation should have been republished as it was a substantial change to the application filed by Transco,” he said.
